The High Court Commercial Division in Kampala has ordered the estate of the late former Supreme Court judge, Prof. George Wilson Kanyeihamba, to pay Shs45 million in damages. The ruling follows a legal battle over the unauthorized use of a researcher’s original work in a revised law textbook without proper acknowledgment or financial compensation.

Justice Stephen Mubiru delivered the landmark ruling, holding that the late jurist infringed on the copyright of Mr. Yusuf Kiwanda. According to the court, the late judge incorporated independently developed research material into a revised version of his 1975 publication, Constitutional Law and Government in Uganda. The contested material was later republished under a new title, Evolution of Constitutional Law, Public Law and Government.

The court specified that the enforcement of this monetary decree against the estate will be strictly limited to property that has validly passed into the hands of the late judge’s legal representatives.
