Uganda’s criminal justice system is facing intense scrutiny as stakeholders demand a comprehensive overhaul of the pre-trial detention framework. Government institutions and human rights advocates emphasize the urgent need to enforce constitutional safeguards, expand access to legal aid, and expedite investigations to stop suspects from languishing in custody for extended periods.

Recent findings underscore the heavy toll of prolonged incarceration. Reports indicate that the households of roughly 98 percent of pre-trial detainees suffer severe income loss, plunging vulnerable families into deep financial distress. Furthermore, Uganda remains among the top five countries globally for prison overcrowding, with some facilities squeezing up to four inmates into space meant for a single person.

Institutional reports, including findings from the Uganda Human Rights Commission (UHRC), point to chronic congestion plaguing facilities like those in the Kigezi region. The crisis is largely driven by delayed investigations stemming from inadequate funding, slow case sanctioning, and persistent judicial backlogs. Without a national legal aid law to institutionalize support for indigent citizens, vulnerable suspects often remain trapped behind bars without adequate representation.

To combat this crisis, proposed reforms urge authorities to improve police bond and bail procedures, strengthen judicial oversight regarding remand decisions, and expand lawful alternatives to detention, especially for juveniles. Additionally, legal bodies continue to press for the immediate release of political detainees, calling for courageous leadership to address systemic bottlenecks.
