A US federal judge has ruled that the Department of Justice acted unlawfully when it fired Maurene Comey, a federal prosecutor in New York and the daughter of former FBI Director James Comey. Ms Comey lost her position in July 2025 and subsequently took legal action against the government, claiming she was targeted because of her father’s public criticism of President Donald Trump and her own perceived political affiliations.
District Judge Jesse Furman delivered the ruling, stating that the dismissal violated the US Constitution as well as Ms Comey’s right to due process. The judge emphasized that while the attorney general holds the power to dismiss federal prosecutors, such actions must follow specific procedures and valid justifications. He noted that Ms Comey had handled high-profile cases—including those involving Jeffrey Epstein, Ghislaine Maxwell, and Sean “Diddy” Combs—while consistently earning top evaluations from supervisors.
The court ordered the Trump administration to reinstate her and provide back pay covering the period from her termination until she accepted a new role in December 2025. Lawyers representing Ms Comey praised the verdict as a triumph for civil servants and the rule of law.
In response to the ruling, a Justice Department spokesperson stated that the agency disagrees with the decision and intends to appeal. Court filings indicated the initial firing decision was made by former Attorney General Pam Bondi.
