Federal prosecutors have initiated legal steps to charge former Federal Bureau of Investigation (FBI) Director James Comey with leaking national defence information, according to recent court filings. This development marks the third time the Justice Department has sought criminal charges against Comey, who is widely known as a prominent critic of President Donald Trump.

While the three-page filing outlines two specific counts, details remain sparse. However, legal representatives for Comey stated that the case originates from an alleged disclosure of classified material to the New York Times back in October 2016, during his tenure leading the bureau.

Responding to the latest development, Comey maintained his innocence in a video posted to Substack. He described the ongoing prosecution as an appalling abuse of the Department of Justice, emphasizing his continued confidence in an independent federal judiciary. His defense lawyer, Patrick Fitzgerald, noted that previous investigations by two distinct prosecutorial teams during the first Trump administration concluded that no charges were warranted.

Legal experts suggest the defense holds a strong position. Former federal prosecutor Glenn Kirschner pointed out that the case may have breached the 10-year statute of limitations, giving Comey’s motion to dismiss a solid chance of success. Critics have characterized the repeated legal actions as politically motivated moves orchestrated by the administration.

Tensions between Comey and Trump date back to 2017 when Trump dismissed him as FBI director amid an investigation into Russian meddling in the 2016 presidential election. Since then, the former FBI chief has faced multiple legal challenges, including a September 2025 indictment that was later dismissed, and an ongoing case related to a controversial social media post.

The latest charges were unveiled on the same day a federal judge ordered the reinstatement of Comey’s daughter, Maurene Comey, after ruling that the administration unlawfully fired her from her position as a federal prosecutor.
