National Unity Platform (NUP) politician and musician Geoffrey Lutaaya has officially closed his case in the High Court of Masaka, where he is challenging the election victory of National Resistance Movement (NRM) candidate Ismael Lubega Kaka for the Kakuto Constituency parliamentary seat.
Appearing before Justice Joyce Kavuma, Lutaaya presented a total of 10 witnesses to support his claims that the January 15 parliamentary election was marred by irregularities. Official Electoral Commission results had previously declared Kaka the winner with 12,029 votes, narrowly beating Lutaaya, who garnered 11,344 votes.
During the proceedings, Lutaaya testified that results from at least seven polling stations were allegedly altered in favor of his rival. He also told the court that critical election materials requested from the Electoral Commission, including certified Declaration of Results forms and tally sheets, were not provided. His legal team further submitted electronic evidence, including video recordings showing scuffles and alleged ballot tampering at the tally center.
Witnesses David Sseremba and Teddy Nanfuka played footage for the court depicting tense moments at the tally center, which included an instance where the returning officer reportedly set aside results from a contested polling station due to compromised ballot-box seals. Lutaaya’s lawyer, Abubakar Ssekanjako, noted that at one specific polling station, an agent refused to sign the results form because the recorded voter turnout exceeded the total number of registered voters.
Lutaaya is asking the court to declare him the rightful winner of the election based on a recount of the disputed areas, or alternatively, to nullify the outcome and order a fresh by-election. The court adjourned the matter to hear testimony and cross-examine seven witnesses for the respondents, which include Kaka and the Kyotera District returning officer.
