The Ministry of Lands, Housing and Urban Development has rolled out updated guidelines aimed at improving the transparency and fairness of issuing special certificates of title. These revised rules focus on standardizing the procedures when duplicate land titles are lost, destroyed, or become illegible.
Lands Minister Judith Nabakooba stated that the new framework ensures that adequate notice is given to any party who might have an interest in the land. This is crucial for protecting individuals whose rights could be affected by the issuance of a replacement title.
The updated guidelines cover various scenarios, including lost or damaged duplicate certificates, court-directed issuances, and applications related to the estates of deceased persons. A key component of the revised process is the publication of notices, which alerts potentially affected parties and gives them an opportunity to lodge objections if they believe an application is flawed or infringes on their rights.
Minister Nabakooba emphasized that the process will uphold the principles of natural justice by offering those affected a reasonable opportunity to be heard, in line with Ugandan law. The guidelines are grounded in foundational legal documents such as the Constitution, the Registration of Titles Act, and the Land Act.
Furthermore, the ministry intends to engage in broader consultations with stakeholders to develop these guidelines into formal regulations under the Registration of Titles Act. This move is expected to strengthen the existing framework and potentially extend regulatory provisions to other areas of land title management.
The overarching goal is to safeguard the integrity of Uganda’s land registry and ensure that the issuance of special certificates is a transparent and accountable procedure. To enhance traceability and accountability, all steps taken during the application process will be meticulously documented and stored in both physical and electronic formats.
