Following the January 2026 general elections, a wave of election petitions alleging irregularities, violence, and result manipulation flooded the High Court. However, a significant number of these legal challenges are failing to proceed to substantive hearings, often being dismissed due to technicalities.
The primary hurdle appears to be the stringent statutory deadlines for filing election petitions and their supporting documents. Many defeated candidates and their legal teams have reportedly missed these critical windows, leading to the outright dismissal of their cases. This means that allegations of ballot stuffing, altered results, and political violence, however credible, may never be judicially reviewed on their merits.
Beyond strict timelines, procedural errors in affidavit submissions are also proving fatal to many petitions. Key affidavits, which form the backbone of any election challenge, are being struck out for minor non-compliance with court rules. This systematic failure to adhere to procedural requirements effectively cripples the petitioner’s case before it can even address the core issues of electoral fairness.
Legal experts suggest that the current framework, while aiming for efficiency, inadvertently creates a situation where the procedural battle is lost before the substantive claims can be heard. This raises concerns about the efficacy of the judicial process in addressing grievances arising from the electoral process and ensuring accountability for alleged misconduct. The outcome of the elections, in many instances, seems to be cemented not at the ballot box, but within the procedural intricacies of the court registry.
