Former Kampala Lord Mayor Erias Lukwago is once again seeking his freedom from Luzira Prison, marking his fourth attempt at securing bail. In an amended application submitted to the High Court’s Criminal Division, Lukwago’s legal team argues that he has fulfilled the criteria for mandatory bail as stipulated by Article 23(6)(b) of the Ugandan Constitution.
Lukwago’s application highlights two key points: his continuous detention for over 60 days without a trial and his critical need for specialized medical treatment that he claims can only be accessed outside of Uganda. These grounds, his lawyers contend, meet the threshold for mandatory release.
This latest move comes after previous bail applications were unsuccessful. The reasons for those rejections have typically centered on the perceived gravity of the charges against him and concerns raised by the prosecution regarding potential interference with ongoing investigations. Lukwago, who also serves as a defence lawyer in other high-profile cases, has faced several periods of detention, sparking discussions about access to justice and the use of criminal charges in politically sensitive matters.
His legal team remains committed to presenting his case for release, emphasizing both his constitutional rights and his pressing medical needs. The outcome of this fourth bail application is keenly awaited, given the prolonged nature of his incarceration.
