An 18-year legal saga involving a Shs53 million loan has finally concluded with a Supreme Court ruling. The court has ordered businessman Ben Kavuya and his money-lending company, Global Capital Save (2004) Ltd, to pay Shs222 million in damages to a Kampala couple, Alice and Michael Okiror.

Furthermore, the apex court mandated the immediate return of a land title that had been held as security for the loan. The dispute originated from a February 2008 transaction where Global Capital Save advanced funds to the Okirors. However, the validity of the mortgage used to secure the loan was questioned.

In a majority decision of 4:1 delivered on September 22, the Supreme Court affirmed previous judgments. The court determined that the mortgage agreement was improperly executed and crucially lacked the necessary written consent from both spouses, rendering it legally invalid. Justice Percy Night Tuhaise, in the lead judgment, specifically directed Mr. Kavuya and his company to hand over the certificate of title for their property located at Kyadondo Block 253, Plot 863 in Lukuli.

This landmark ruling brings a significant legal burden to a close for the Okiror couple, who had been entangled in this protracted legal battle for nearly two decades over what the court deemed an invalid financial arrangement. The substantial damages awarded reflect the prolonged distress and legal costs incurred.
