A man facing grave charges including treason, murder, aggravated robbery, and illegal possession of firearms has been released on mandatory bail by the High Court. This decision comes after he spent several months in custody, awaiting the transfer of his case from the General Court Martial to the appropriate civilian courts.

Mr. John Masembe, also known as Nassi, was granted bail by Justice Paul Wolimbwa Gadenya in Kampala. The High Court ruled that the State could no longer legally detain Mr. Masembe based on accusations that, following a pivotal Supreme Court judgment, fall outside the jurisdiction of military tribunals.

This ruling is one of the most tangible outcomes of the Supreme Court’s January 2025 decision, which declared the trial of civilians by military courts unconstitutional. The Supreme Court’s directive aimed to ensure that all citizens are subject to the same legal framework and trials in civilian courts, upholding fundamental rights to a fair trial.

The prolonged detention of civilians by military courts, even when facing charges that should be heard in civilian jurisdictions, has been a point of contention. This latest bail grant underscores the practical application of the Supreme Court’s order, providing relief to individuals caught in this legal limbo and reinforcing the principle of judicial oversight.

The implications of this ruling extend to numerous other cases where civilians may have been or are currently being held by military authorities. It sets a precedent for the swift transfer of such cases and highlights the importance of adherence to constitutional court pronouncements by all state organs.
