High Court Rejects MP Nabukenya's Bid for Election Documents

The Luweero High Court has denied a request by Member of Parliament Brenda Nabukenya to obtain crucial election documents. Nabukenya, the Woman MP for Luweero, had sought access to materials used by the Electoral Commission in the January 15 parliamentary elections as part of a petition challenging her win.

Justice Vincent Emmy Mugabo, presiding over the case, ruled against the application, stating that the applicants had not provided sufficient justification for their need for the documents, specifically the Declaration of Results forms. Consequently, the court ordered the applicants to bear the Electoral Commission’s legal costs.

The application stemmed from an election petition filed by Agnes Kirabo, who contests Nabukenya’s victory. Both Nabukenya and Kirabo’s legal teams have agreed to submit necessary documents by October 23rd, foregoing witness cross-examination in this particular aspect of the case. Justice Mugabo has scheduled November 6th for the ruling on Kirabo’s petition.

In a separate but related matter, Justice Mugabo also presided over proceedings for an election petition filed by Esther Nakawooya against Sarah Najjuma, the Nakaseke Woman MP. Similar to the Luweero case, both parties agreed to file documents electronically by October 23rd instead of engaging in witness cross-examination.

Justice Mugabo commended the parties for their agreement and has set November 10th as the date for the ruling in the Nakawooya-Najjuma petition. These proceedings mark the final physical court appearances for the parties involved before the judgments are delivered.
