Masaka High Court to Rule on Disqualification of Ssodo's Lawyers September 23

The Masaka High Court is set to deliver a significant ruling on September 23 concerning an election petition, specifically addressing an application to disqualify several lawyers representing incumbent MP Fred Ssonko Ssali, commonly known as Ssodo.

Election petitioner Jet John Tumwebaze has lodged the application, asserting that some of Ssodo’s legal team previously represented him in the same election petition. Tumwebaze argues that this prior representation creates a conflict of interest, making it improper for these lawyers to now represent his opponent in the very same matter.

This legal challenge has introduced a new dimension to the election dispute. Ssodo, however, has raised concerns that this move by Tumwebaze could lead to further delays in the determination of the main election petition. He questioned the timing of the application, noting that Tumwebaze had been aware of and seen these lawyers involved in the case for several months without objection.

“He has spent six months pursuing this case with my lawyers present. He saw them and knew that these are the lawyers who would represent Ssodo, but at the last minute he files an application against them,” Ssodo stated, suggesting the application might stem from fear of his lawyers’ capabilities or a weakness in the petition itself.

Tumwebaze’s application hinges on the legal principle that advocates who have previously acted for a party in a specific case are generally restricted from acting against that same party in the same matter due to potential conflicts of interest and the risk of confidential information being misused.

The court’s decision on September 23 will be pivotal, determining whether Ssodo’s current legal representation can stand or if adjustments will be necessary before the substantive hearing of the election petition can proceed.
