Masaka Court to Rule on Tumwebaze's Bid to Disqualify Sodo's Lawyers

A significant legal development is unfolding in the Masaka High Court as the ruling on Jet John Tumwebaze’s application to remove several of Godfrey Aine Kaguta Sodo’s lawyers is slated for September 23.

Tumwebaze, an election petitioner, has lodged a fresh application arguing that certain members of Sodo’s legal team previously represented him in the same election petition. He asserts that this prior representation creates a conflict of interest, making it improper for them to now represent his opponent.

This legal maneuver adds another layer of complexity to the ongoing election dispute. Sodo, however, has questioned the timing of Tumwebaze’s application, noting that it comes after months of proceedings where these lawyers have been actively involved. He suggests the application might stem from either a fear of his legal team’s effectiveness or a lack of confidence in the strength of the petition itself.

Sodo expressed his bewilderment, stating, “He has spent six months pursuing this case with my lawyers present. He saw them and knew that these are the lawyers who would represent Ssodo, but at the last minute he files an application against them.” He further questioned, “That means he is either afraid of Sodo’s lawyers because of their ability, or he is afraid that the case he filed is weak.”

The court’s decision on this application will precede any further proceedings in the main election petition. Tumwebaze’s motion is grounded in the legal principle that advocates who have previously represented a party in a matter should be barred from acting against that former client if it could lead to a conflict of interest or the misuse of confidential information.

The September 23 ruling will be pivotal in determining whether the lawyers in question can continue their representation of Sodo in this electoral challenge.
