DPP Fights Lukwago's Bail, Cites Flight Risk and Influence

The Director of Public Prosecutions (DPP) is arguing against the bail application of Erias Lukwago, president of the People’s Front for Freedom (PFF). In an affidavit submitted to the High Court’s Criminal Division, the DPP contends that Lukwago poses a flight risk and could potentially influence prosecution witnesses owing to his prominent political standing.

Lukwago, 56, faces charges of misprision of treason, accused of failing to report alleged plans to overthrow the government between 2021 and November 2024. The prosecution alleges he had knowledge of treasonous intentions by opposition figures but did not inform the authorities.

In his bid for bail, Lukwago has invoked the constitutional presumption of innocence and highlighted concerns about his health, stating that prison conditions may not adequately address his specialized medical needs. However, the state disputes these health claims, asserting that prison medical personnel are equipped to provide necessary treatment.

The DPP also refutes allegations that Lukwago suffered mistreatment in detention. Instead, the prosecution emphasizes Lukwago’s influence as a senior advocate, former Kampala Lord Mayor, and PFF president, suggesting this could be leveraged to obstruct the legal proceedings. The state further questions the adequacy of the sureties Lukwago has presented, arguing they do not guarantee his appearance in court.

Given the severity of the misprision of treason charge, which carries a potential life sentence, the prosecution submits that Lukwago has a greater incentive to abscond if granted bail. The court is scheduled to rule on the bail application on July 30.

Lukwago’s lawyer, Medard Lubega Sseggona, reiterated concerns about his client’s deteriorating health and the capacity of prison healthcare to manage his condition, though he acknowledged efforts by the Uganda Prisons Service. Sseggona indicated that legal arguments were presented in writing, with a ruling expected soon.
