A lawsuit filed in San Francisco County Superior Court accuses OpenAI, the creator of ChatGPT, of providing medical advice that nearly cost a Florida man his life. Scott Winters, a 55-year-old pastor, claims the popular AI chatbot repeatedly offered incorrect medical guidance and discouraged him from seeking professional help, ultimately leading to a severe pulmonary embolism.
Winters’ legal team alleges that ChatGPT misdiagnosed his recurring dizzy spells and blood pressure issues, even advising him to remain sedentary despite his deteriorating health. The lawsuit further contends that the AI incorporated aspects of Winters’ Christian faith into its responses, offering spiritual reassurances that fostered a dangerous reliance on the chatbot over actual medical care.
According to court documents, Winters became isolated from family and friends who urged him to see a doctor, as he came to trust ChatGPT’s advice. This reliance, combined with the AI’s purported sycophantic and authoritative tone, allegedly led to Winters’ immobility, a critical factor in the blood clots that caused his near-fatal condition.
The plaintiff is seeking financial damages and is asking the court to mandate that OpenAI implement safeguards to prevent similar harm to other users. OpenAI, through a spokesperson, has stated that ChatGPT is not a substitute for professional medical advice and should not be used as such. They acknowledge that users often seek health information online and suggest AI can assist in organizing questions for medical professionals.
