Uganda Reaffirms ICC Commitment Amidst Bashir Warrant Controversy

On July 10, 2009, Uganda sent a clear message of its continued adherence to the International Criminal Court (ICC), despite a growing divide within the African continent regarding the arrest warrant issued against Sudanese President Omar al-Bashir.

This reaffirmation by Uganda’s Ministry of Foreign Affairs followed an African Union summit where member states had signaled a reluctance to cooperate with the ICC’s demand for Bashir’s arrest. The warrant, issued in March 2009, cited alleged war crimes and crimes against humanity in Sudan’s Darfur region.

Uganda stated that while it remained committed to the ICC’s principles, it supported the African Union’s plea for a 12-month deferral of the case by the UN Security Council, invoking Article 16 of the Rome Statute. This stance placed Uganda, an early supporter of the ICC and the first nation to make a state referral to the court concerning the Lord’s Resistance Army (LRA) in 2003, at the centre of a significant diplomatic debate.

At the time, Foreign Affairs Minister Sam Kutesa explained that the African Union’s position stemmed from concerns over the timing and potential repercussions of prosecuting a sitting head of state, rather than a rejection of the ICC’s mandate.

The situation intensified with reports indicating that President Bashir might visit Uganda, raising questions about whether Kampala would be obligated to apprehend him. Bashir ultimately cancelled the planned visit, averting an immediate diplomatic clash. However, he would later visit Uganda on two separate occasions while the arrest warrant remained active, including attending President Yoweri Museveni’s 2016 swearing-in ceremony and undertaking a state visit in 2017.

These events highlight the intricate balance Uganda has sought to maintain between its international legal commitments and the political solidarity urged by regional bodies, particularly concerning the handling of cases involving African leaders.
