Besigye, Lutale Reject Court's Lawyer Suggestions, Insist on Karua and Lukwago

Veteran opposition figure Dr. Kizza Besigye and his co-accused, Hajj Obeid Lutale Kamulegeya, have firmly stated their refusal to part ways with their chosen legal team, which includes Kenyan Senior Counsel Martha Karua and former Kampala Lord Mayor Erias Lukwago. In a letter addressed to Justice Emmanuel Baguma from Luzira Government Prison, the two detainees expressed their commitment to being represented by their preferred lawyers, despite current unavailability.

Besigye and Lutale allege that the state has intentionally disrupted their defense by arresting Lukwago and deporting Karua. They claim Lukwago was apprehended after attempting to serve court documents related to a human rights application and subsequently charged with misprision of treason. Karua, appointed to lead their defense, was reportedly deported and declared a prohibited immigrant, actions the accused believe were designed to deny them representation of their choice.

These objections arise from directions issued by Justice Baguma concerning their recent bail application and a human rights enforcement case. The accused criticize the court’s compressed timeline for responding to the bail application, deeming it unrealistic for incarcerated individuals without legal representation. They also question the sudden scheduling of the bail hearing shortly after their legal team’s disruption.

Furthermore, they are seeking a postponement of at least three weeks to adequately prepare their case and have raised concerns about the proper service of court documents on the respondents in the human rights case, including Gen. Muhoozi Kainerugaba and others. They intend to seek cross-examination of the respondents and those who filed affidavits in reply.

The accused reject the court’s suggestion to appoint alternative lawyers, arguing it disregards their current circumstances. They also report difficulties in reviewing prosecution evidence due to restrictions on consulting with lawyers, despite previous court orders. Besigye and Lutale have filed a separate application addressing these representation issues, asserting that their legal team’s restoration is paramount before proceeding with any other matters.

Besigye and Lutale were arrested in Nairobi in November 2024, with the prosecution alleging their involvement in plans to overthrow the Ugandan government. Some opposition figures, including Erias Lukwago, are alleged to have participated in discussions related to these plans, which were reportedly recorded by an informant.
