Besigye's Defence Team Faces Legal Hurdles Amidst Arrests and Denied Entry

The legal team representing Ugandan opposition stalwart Dr. Kizza Besigye has encountered a series of severe setbacks, raising questions about the state’s influence on legal representation and the right to a fair trial. The situation escalated with the arrest of Kampala’s Lord Mayor and Besigye’s lead counsel, Erias Lukwago, on June 15th. Lukwago was subsequently charged with misprision of treason and remanded to Luzira Prison, accused of failing to disclose information about an alleged treasonous plot.

Despite Lukwago’s detention, his defence team, led by Medard Ssegona, asserts that this does not impede his ability to represent Besigye, emphasizing the client’s right to choose their counsel. However, further complications arose when Kenyan Senior Counsel Martha Karua, co-lead counsel for Besigye, was denied entry into Uganda upon arrival at Entebbe International Airport.

Karua, who has previously represented Besigye in Ugandan courts, was reportedly detained and held without communication. Her exclusion, coupled with Lukwago’s incarceration, has intensified concerns about Besigye’s defence. Ssegona suggested that Karua could still participate remotely, even if physical presence is barred.

The defence team, while expressing confidence in Lukwago’s prospects for bail, also raised concerns about his health, requesting access to medical treatment. Separately, the High Court awarded Shs100 million to a URA customs officer in a defamation case involving online messages, underscoring the legal ramifications of digital communication. In another development, Christopher Okello Onyum appealed his death sentence for murder, arguing insufficient evaluation of evidence and his mental condition.

These unfolding events highlight the judiciary’s engagement with complex issues ranging from political rights and fair representation to digital accountability and criminal justice. Despite the obstacles, Besigye’s remaining legal team, including Counsel Eron Kizza, has affirmed their commitment to proceeding with the case.
