Supporters of former Kampala Lord Mayor Erias Lukwago experienced significant anxiety and frustration Tuesday when the Makindye Chief Magistrate’s Court postponed its decision on his bail application. The delay means Lukwago will remain incarcerated at Luzira Prison, fueling worries about his declining health.
Lukwago, who is facing a charge of misprision of treason, was brought to court under heavy security. His supporters, clad in the colours of the People’s Front for Freedom (PFF), filled the courtroom and surrounding areas, eagerly awaiting the ruling scheduled for 2:00 PM.
However, shortly before the appointed time, lawyers for both the defence and prosecution were summoned to the magistrate’s chambers. This deviation from open court proceedings sparked speculation and concern among the gathered crowd. Lead defence lawyer Medard Lubega Ssegona later emerged to deliver the news that the Chief Magistrate’s ruling was not yet ready.
Ssegona explained that the magistrate opted against announcing the delay in the packed courtroom due to the highly charged atmosphere, deeming it inadvisable to gather the crowd under such circumstances. The magistrate committed to delivering the ruling electronically via the Electronic Court Case Management Information System (ECCMIS) within 24 hours.
Beyond the bail delay, Lukwago’s health was a major point of discussion. His defence team highlighted that he suffers from a spinal condition requiring specialized treatment unavailable in prison. They expressed fears that his health is worsening daily, drawing parallels to past cases where inmates with serious health issues died in custody.
The State has opposed Lukwago’s bail, citing the gravity of the charges and national security concerns. The proceedings also occurred amidst controversy over the deportation of Kenyan lawyer Martha Karua, who intended to attend the hearing.
As supporters dispersed, uncertainty lingered about the upcoming electronic ruling, with Lukwago remaining in prison as his health condition remains a pressing concern for his legal team and followers.
