Senior Police Officers Face Contempt Charges for Alleged Court Order Defiance

Applications have been filed in the High Court’s Land Division seeking to initiate contempt of court proceedings against Commissioner of Police James Kusemererwa and Superintendent of Police Sam Suubi. These senior officers are accused of willfully disobeying court orders issued on March 16, 2021, which were intended to preserve the status quo on a contentious piece of land.
According to court filings by MKS Limited, the aggrieved party, the officers allegedly facilitated the forceful entry and attempted eviction of tenants from land located on Kyadondo Block 216. Despite being aware of the court’s injunctive orders, it is alleged that the respondents, along with other individuals, used force and tools, including firearms and a crane, to gain access to the property on June 8, 2026.
The application further seeks a declaration that the police officers are in contempt, proposing sanctions that include a substantial fine and potential arrest and commitment to civil prison. MKS Limited asserts that these actions were a deliberate attempt to undermine the authority of the court and thwart the legal process concerning the land’s ownership.
The substantive case involves MKS Limited challenging the cancellation of its land title and seeking its reinstatement, arguing it is a bona fide purchaser. The company contends that its prior occupation of the land predates the disputed subdivision, making the alleged trespass and eviction attempts unlawful. The court’s decision on these contempt proceedings is awaited.
