Erias Lukwago's Bail Ruling Deferred Amidst Health Concerns

The Makindye Chief Magistrate’s Court has reserved its ruling on a bail application for former Kampala Lord Mayor Erias Lukwago. His legal team presented compelling medical arguments, highlighting a severe deterioration in his health while in detention at Murchison Bay Prison.

Lukwago’s lawyers emphasized that he suffers from a dislocated spinal disc, causing excruciating pain and requiring specialized treatment, including an MRI-guided diagnosis, which they argue cannot be provided within prison facilities. They also raised concerns about potential exposure to tuberculosis due to overcrowding in the prison environment and noted laboratory tests indicating a weakened immune system.

The defence urged the court to expedite its ruling or, alternatively, to grant Lukwago referral to Mulago National Referral Hospital for immediate medical attention. They stressed that his current condition necessitates urgent specialized care.

Conversely, the State, represented by State Attorney Barbara Masinde, opposed the bail application. The prosecution encouraged the court to base its decision solely on the written submissions already provided by both parties, asserting that they had received full information regarding the applicant’s health status.

Despite the arguments, Chief Magistrate Sarah Basemera acknowledged that both sides had adhered to procedural timelines. The ruling has now been deferred to 2 PM, leaving Lukwago in custody as the court deliberates on the critical health and legal points.

Last week, Lukwago was charged with misprision of treason for allegedly failing to report information about a treason plot. He has pleaded not guilty to the charges, and investigations are ongoing. This case continues to attract considerable political and legal interest.
