Kenyan Human Rights Advocate Peters Chief Justice Over Lukwago's Arrest

Kenyan legal luminary and former Minister of Justice, Martha Karua, has lodged a formal complaint with Uganda’s Chief Justice, Flavian Zeija, and Attorney General, Sam Mayanja. Her petition addresses the recent arrest and prosecution of prominent lawyer Erias Lukwago, which she contends signals a worrying decline in Uganda’s adherence to the rule of law.

In a letter dated June 16, Karua, who possesses a special permit to practice in Ugandan courts, highlighted what she perceives as an erosion of judicial independence. She urged the top legal officials to take immediate action to address the situation.

Karua described Lukwago’s arrest as a “direct affront to the authority and dignity of the courts,” characterizing it as “brazen intimidation.” She stated that such actions not only target Lukwago but also aim to intimidate other advocates who represent individuals perceived as unfavorable to the government.

Lukwago, a former Kampala Mayor and a defense lawyer for opposition figure Dr. Kizza Besigye, was apprehended at his home. His arrest was followed by a social media post from the Chief of Defence Forces, Muhoozi Kainerugaba, which drew considerable criticism. Lukwago was later charged with misprision of treason.

Karua emphasized that safeguarding the judiciary’s independence and ensuring advocates can perform their duties without fear falls directly under the Chief Justice’s mandate. She also reminded the Attorney General of his duty to advise state officials against actions that contravene the Constitution and Ugandan laws, particularly referencing the non-partisan and subordinate nature of the Uganda People’s Defence Forces as stated in the Constitution.

Lukwago was reportedly arrested as he was preparing to serve court summons on Kainerugaba in a separate legal matter. Karua implored both the Chief Justice and Attorney General to act swiftly to uphold the rule of law and protect fundamental freedoms, including Lukwago’s rights to liberty and due process. She stressed the importance of protecting lawyers as they carry out their professional duties, as guaranteed by Ugandan law.
