The legal team representing opposition figure Dr. Kizza Besigye and Hajj Obeid Lutale has cautioned that upcoming court proceedings on June 30th may encounter significant delays. This concern stems from disruptions within the defense counsel, specifically the absence of senior advocate Elias Lukwago, and challenges in serving court summons on prominent military officials.
Defense lawyer Kato Tumusiime highlighted that the legal team was assembled with specific expertise, making each member’s participation crucial. Lukwago, in particular, has played a vital role in drafting key applications and strategizing the defense. Tumusiime emphasized that the clients have the constitutional right to choose their legal representatives, and a consultation will determine if the trial can proceed effectively without Lukwago or if adjustments to the hearing schedule are necessary.
Beyond internal team challenges, the defense is also grappling with serving court summons on the Chief of Defence Forces, General Muhoozi Kainerugaba. Tumusiime stated that the responsibility for serving documents lies with the entire defense team as officers of the court and urged that any objections should be directed towards the judge who issued the summons, not the “messenger.”
The team is exploring all lawful methods to serve General Kainerugaba, including electronic service via phone or email, physical delivery to his residence, or, as a last resort, substituted service through newspaper publications. The court is set to reconvene on June 30th, with the possibility of adjournment looming due to these unresolved issues.
