Katanga Trial: Defence Pathologist Admits Critical Gaps in Analysis

The defense’s forensic account in the murder trial of businessman Henry Katanga faced renewed challenges this week as Dr. Sylvester Onzivua, a retired forensic pathologist, admitted to considerable gaps in his analysis.
Appearing for his fourth round of cross-examination, Dr. Onzivua was pressed by Chief State Attorney Jonathan Muwaganya regarding his examination of the circumstances surrounding Katanga’s death. The prosecution emphasized the importance of the crime scene’s overall appearance, including body position, firearm location, and blood patterns, as crucial evidence in reconstructing events.
Dr. Onzivua conceded that investigating the circumstances of a death falls within a forensic pathologist’s professional duties. However, he later admitted he had never examined the injuries sustained by the primary suspect, Molly Katanga, despite the defense previously relying on these injuries to support their version of events.
He also acknowledged that while his expertise extends to analyzing wounds on living individuals, he had not personally assessed Molly Katanga’s wounds. Furthermore, when questioned about his ability to reconstruct the deceased’s final moments based on materials provided by the defense, Dr. Onzivua ultimately admitted he could not determine whether Henry Katanga was standing, sitting, or lying down when he suffered the fatal gunshot.
Discrepancies in Dr. Onzivua’s defense report also surfaced. He admitted that a statement about Molly Katanga’s blood being prevalent in the room, while the deceased’s blood was only on the bedsheets, was not explicitly found in the blood pattern analysis report he consulted. He maintained that his conclusion remained valid despite this omission.
This hearing marked Dr. Onzivua’s fourth appearance under cross-examination. Molly Katanga denies the murder charge, while other co-accused face charges of being accessories after the fact and destroying evidence. The trial continues.
