Engineer Fredrick Mubiru has had his suspension from professional practice quashed by the High Court. The ruling comes after Mubiru challenged his one-year suspension, initially imposed by the Engineers’ Registration Board (ERB) based on allegations of professional misconduct stemming from a complaint by the National Building Review Board.
Mubiru argued that the disciplinary process was flawed and did not adhere to the principles of natural justice. Although the ERB conducted a fresh hearing after a previous court order, they recommended the same one-year suspension. Mubiru contended that the inquiry was not full, fair, or impartial. He cited illegality, irrationality, and procedural impropriety in the board’s decision-making.
Justice Joyce Kavuma concurred with Mubiru, finding that his right to a fair hearing was indeed violated. The judge stated that the disciplinary proceedings did not meet the required legal standards, rendering the ERB’s decision legally indefensible. Consequently, the court set aside the suspension, marking a significant legal victory for the engineer and a setback for the regulatory board.
The ruling underscores the importance of due process in disciplinary actions by professional bodies. Regulatory institutions are mandated to handle complaints justly, provide adequate opportunities for individuals to respond, and base decisions on impartial inquiries. The court’s intervention highlights that failure to follow these fundamental principles can lead to the overturning of disciplinary measures.
Experiencing the suspension halted Mubiru’s involvement in crucial projects, including several under the Ministry of Energy and Mineral Development and works at the Military Hospital in Mbuya, where he was serving as project manager. The quashed suspension now enables him to resume his project management responsibilities. This case serves as a critical reminder for disciplinary bodies to balance accountability with procedural fairness in their operations.
