Kenya’s High Court has issued a significant ruling, placing a temporary freeze on the establishment of a U.S.-backed Ebola quarantine facility on Kenyan soil. The order, handed down by Justice Patricia Nyaundi, also prohibits the admission of any individuals exposed to or infected with Ebola into Kenya under the proposed agreement with the United States.
This judicial intervention follows a legal challenge brought forth by the Kenyan rights organization, Katiba Institute. The group approached the court to contest the plan, which they argue was initiated without adequate public consultation and raises serious constitutional questions.
Katiba Institute specifically highlighted concerns pertaining to the rights to life, health, fair administrative processes, public participation, and parliamentary oversight. They described the facility’s establishment as secretive and unilateral, emphasizing the potential ramifications for Kenyan citizens and the nation’s governance structures.
The White House had previously announced the facility’s purpose: to quarantine U.S. citizens who had come into contact with Ebola. The policy indicated that symptomatic individuals would not be repatriated to the U.S. but would instead be transferred to a third country for treatment.
Justice Nyaundi has scheduled the next hearing for this critical case on June 2, at which point the legality and future of the proposed Ebola quarantine center will be further scrutinized. The court’s temporary suspension underscores the importance of transparency and legal due diligence in international health agreements.
