Ntungamo Father Gets 50 Years for Defiling His 7-Year-Old Daughter

The High Court in Ntungamo District has handed down a significant 50-year prison sentence to a 45-year-old father convicted of aggravated defilement against his own seven-year-old daughter.

Justice Lawrence Tweyanze Karikwisya, presiding over the trial, stated that the evidence presented by the prosecution, particularly the testimony of the young victim, was compelling. The judge underscored the gravity of the offense, noting the offender’s betrayal of the trust placed in him as a father who should have protected his child.

Despite defense arguments for a reduced sentence, citing the offender’s other children and time served on remand, the judge determined a deterrent sentence was necessary. “Aggravating factors outweigh mitigating factors. This is a case of a violent father destroying a whole life of an innocent victim,” the judge remarked, commending the child’s courage in reporting her father and testifying in court. The court found Kukundakwe’s actions to be beyond human behavior, deserving of maximum separation from the public.

The offenses occurred in November 2022, when the victim was left alone at home with her father after her mother fled due to domestic issues. The child reported enduring multiple instances of abuse and pain, eventually confiding in a neighbor who alerted the police and sought medical attention for her.

This case highlights the ongoing concern over defilement in Uganda. Police data indicates a significant number of defilement cases recorded annually, with a disturbing percentage involving relatives. Challenges such as lack of evidence and potential corruption at the police level can impede prosecution, while societal issues like poverty and cultural practices are often cited as contributing factors to sexual violence against minors.

This sentence reflects the court’s stance on protecting vulnerable children and deterring similar heinous crimes. The father will serve 46 years after remission for time spent on remand, as reported by the Daily Monitor.
