High Court Rejects King Ceasor University Med Grad's Internship Lawsuit

The High Court in Uganda has turned down a legal challenge from Henry Gavin Mukalazi, a 2023 Bachelor of Medicine and Bachelor of Surgery graduate from King Ceasor University. He sued the National Council for Higher Education (NCHE) after they refused to recognize his qualifications, preventing his internship deployment.

Mukalazi had entered the medical program using a Bachelor’s in Diagnostic Ultrasound from Ernest Cook Ultrasound Research and Education Institute, earned in 2016. That degree stemmed from a Certificate in Comprehensive Nursing, which the court ruled did not satisfy Uganda’s minimum entry standards for bachelor’s programs.

In his petition, Mukalazi claimed NCHE neglected its duties by permitting his studies and tuition payments, then invalidating his credentials. He argued the denial violated his right to practice medicine.

Acting Judge Bonny Isaac Teko rejected these arguments, stating the foundational qualifications were inadequate, making all subsequent credentials irregular. The judge clarified that professional rights in medicine require statutory compliance, including recognized degrees and supervised internships as per the Medical and Dental Practitioners Act.

The court noted NCHE’s role is qualification recognition, not internship deployment—that falls to the Medical and Dental Practitioners Council. NCHE properly exercised its authority in this matter.
