Besigye and Co-Accused Challenge State's Push to Hide Treason Trial Witnesses

Retired Colonel Dr. Kizza Besigye, alongside Obeid Lutale, has firmly opposed the prosecution’s move to keep the names of six witnesses secret in their treason trial before High Court Justice Emmanuel Baguma. They argue this violates their right to a fair and public hearing.

The trio—Besigye, Lutale, and UPDF Captain Denis Oola—face charges of conspiring to overthrow the government via meetings in Geneva, Athens, Nairobi, and Kampala. Prosecutors, headed by Thomas Jatiko and Richard Birivumbuka, cite security risks for the concealment bid.

In affidavits, Besigye and Lutale called the request a ‘trial by ambush,’ stressing it blocks proper cross-examination. Besigye detailed his alleged abduction from Nairobi on November 16, 2024, during a book launch, followed by incommunicado detention at Makindye Military Barracks.

Defence lawyers, including Martha Karua, Erias Lukwago, and others, slammed prosecutors for tardiness, pushing for dismissal. Justice Baguma gave them a last chance, accepted an apology for delays, and ruled proceedings could continue.

The court permitted cross-examination of affidavit supporter Joseph Kyomuhendo on April 24, 2026. State claims include soliciting $5,000 for recruit training in Kenya, pursuing missiles, and gathering audio-video proof of the plot.
