The 2026 general elections in Uganda have wrapped up, shifting the focus from polling stations to courtrooms. Losing candidates, unhappy with outcomes, are readying election petitions, while the Electoral Commission has finished its work despite complaints over unopposed declarations and other issues.

As the ultimate guardian of the rule of law, the Judiciary must now ensure impartiality, transparency, and swift resolutions. Past cycles in 2016 and 2021 drew heavy criticism for inconsistent rulings, eroding trust and distorting earlier legal precedents from 2001 to 2011.

Challenges like voter bribery, violence, ballot stuffing, and low turnout highlight deep democratic flaws. In Uganda’s emerging democracy, judicial independence faces threats from political meddling, corruption, and poor infrastructure, risking perceptions that courts override voter choice.

The handling of these petitions will test the Judiciary’s credibility, balancing speed with thorough due process to safeguard electoral integrity.
